Terms and Conditions

Everything sold as-is, where-is, no warranties written or implied. Buyers shall rely entirely on their own judgment and inspection of property. Nor is any item guaranteed to be of any particular age, year of manufacture, model, make or condition. Both buyer and seller acknowledge their person and property are at the auction site at their own risk. No person shall have any claim against auctioneers, their agents, employees or principals for any injuries sustained nor for damages to or loss of property which may occur from any cause whatsoever. All oral statements made auction day supersede any printed materials. Food, beverages and restrooms are available onsite.
TERMS OF PAYMENT: Complete payment due day of sale. No property removed until settled. Sachs 5th Auction accepts cash, major credit, debit cards, and bank certified cashier's checks. Checks with a bank letter of guarantee will be accepted or pre-approved and already known and established accounts with Sachs 5th Auction. Please have proper identification with you. No dealer's drafts will be accepted. The only payment accepted from internet bidders is by credit card up to $10,000 and wire transfer over $10,000. Absentee bids welcome. NOTE: Absentee bids $200 and under will be started at highest bid.
BANK LETTER OF GUARANTEE: A personal or company check will be accepted only when accompanied by a bank letter guaranteeing payment. This letter must be on a bank letterhead and must state (1) that payment is guaranteed; (2) that the guarantee is valid for 30 days after receipt in the Sales Office; and (3) that the guarantee covers the purchase from Sachs 5thAuction. The letter must be signed by a bank official authorized to guarantee payment. (See example to the right.)
SPECIAL NOTE: Pick up items on the day of sale or Monday after the sale between the hours of 8 a.m. and 5 p.m. Bring help and tools to remove your items. Everything must be removed by 5 p.m. Monday after the sale. NOTE: Pickup for items located at America's Self Storage available only Mon-Fri, 9 a.m. to 4 p.m. the week following the sale.
The venue & jurisdiction is Valencia County in the State of New Mexico and none other. Credit card charge backs will not be accepted.
NOTICE TO CONSIGNORS: All items passed will be donated to charity unless consignor picks up passed items by 5:00 pm the day following the auction.

Our Auction House is located in downtown Belen, New Mexico. Family owned and operated, we strive to hold the best, most professional auctions possible, held anywhere. In addition, we want our auctions to be a fun, entertaining experience for all. Although fast paced, our auctions have a relaxed atmosphere. Our auction house is clean and comfortable, with nice restroom facilities. You need not go hungry here either. The Breakfast Optimist Club has a concession stand onsite. You can have your coffee and donut in the morning, and a grilled hamburger & chips for lunch! Their menu is very reasonably priced, and the Optimists retain all proceeds from their sales to benefit youth programs.

Can't make it to our auction? Bid online! Through www.proxibid.com/sachs you can bid ahead of time, or live in real time during the auction. Some of our local customers enjoy our auctions from the comfort of their homes, and pick up their purchases after the auction. For those of you who are not local, we can ship your winning bid to you!
